But that movement data will be the same for the driver and the passengers, so they only show that you are in a vehicle, not necessarily driving. So using this would also block texting for passengers which doesn’t make any sense.

This is bullshit, Telcos could easily disable texting and driving. They could tell who is driving looking at the 6 axis movement data.
