If you’re talking about Elmo the article stated that the dismissal was sought using anti-SLAPP legislation, which is exactly what those laws were meant for. I didn’t see if the article said that the court would in addition to dismissing the case would find for a penalty against Musk.

No sentencing at all. They lost a civil lawsuit in which they were the plaintiff
